    鉴证实录

    今天是来澳洲后第一次去旁听这里的法庭.说起来法律还是我的"本家",我就是从法律转到商科的.本来今天休息想睡会觉,可怎么也睡不着,就起来去了法院旁听同学的官司.

    这里的法院戒备森严,和机场一样,门口放了两台大型X光机检查行李和背包.我一进门就一肚子牢骚.老百姓要经常打交道的东西就不能把门槛放得那么高,人家一进门就紧张还怎么打官司?资本主义就是会搞白色恐怖,只不过换了个借口叫反恐.

    今天去的当然是民事法庭.在这几条街上几乎集中的全都是法庭机构,从县法院到中级法院到高法,还有几个特别法院.所以街上走的不是带哈巴狗卷毛帽子的律师法官,就是心事重重的告方和被告.警察巡逻也比较多.

    说到民事法庭,当然是重中之重.主要是因为西方的民事法律比较发达,民事诉讼比较频繁,而且治安也比较好,刑事法庭门可罗雀,民事法庭却多达数十个.

    去到法庭里边,等到法官进来起立后,我才有机会慢慢观察.法官穿着比较随和,坐在近两米高的桌子上,让人感觉亲和之余也颇有威严.旁边是两个书记,一个负责引导当事人拿圣经发誓,一个负责转递证据等工作,不过给人感觉相当不敬业.其中一个在听到某人的感情经历时还笑了一下,被我恨恨瞪了一眼,随后才把脸撇了下来.

    民事法庭一般不会有人旁听,不知道是有规定还是事情太琐碎没人感兴趣,只有当事人们按照顺序坐在前后两排椅子上.有趣的是,我观察到大部分人的心理都相当紧张,都选择坐后排而不是前排的椅子,而且许多人都不停的颤腿!而这个细节在侦探小说里讯问罪犯的时候经常见到.我是事不关己高高挂起,几次想一个人冲到前排细听,可都被同伴挡回来.

    也许是害怕紧张的原因,有一个当事人请了中文翻译,可实际上我听法官询问的时候一点也不觉得困难,法官的问题比较简洁明了,而且也不允许太多的补充说明,一般问什么回答什么就足够了.

    最后等了一个半小时才开庭的法庭程序半小时就结束了,我对澳洲的法院有了大概的印象.
